Terms and Conditions – United Kingdom

1. Who we are

The seller is OosterHard Commerce, trading as SuperBonsai, a sole proprietorship established in the Netherlands.

2. Scope

These terms apply to online sales to consumers in the United Kingdom. They do not remove or restrict rights that cannot lawfully be excluded under UK consumer law.

3. Product information and contract formation

We aim to describe products, prices, ingredients, quantities, use instructions and warnings accurately. Obvious errors are not binding. By submitting an order, the customer makes an offer to purchase. A contract is formed when we send an acceptance or dispatch confirmation.

4. Prices, taxes and payment

Prices and mandatory charges applicable to the order will be shown before checkout is completed. Delivery charges are shown separately where applicable. Any import VAT, customs duty or handling charge not collected at checkout must be dealt with under the rules applicable to the shipment and will be disclosed where legally required. Payment is made through the methods offered at checkout.

5. Delivery

Orders are dispatched from the Netherlands. The normal estimated delivery time to the United Kingdom is 7 to 14 working days. This is an estimate unless a binding date has expressly been agreed. Risk of loss or damage remains with us until the goods are received by the consumer or a person nominated by them.

6. Cancellation rights

A UK consumer normally has 14 days after receiving the goods to tell us that they wish to cancel. The customer may cancel by sending a clear statement to info@superbonsai.eu. The goods must then be returned within 14 days to OosterHard Commerce, Weteringweg 18, 2641 KM Pijnacker, the Netherlands.

The customer pays the direct return cost for a change-of-mind cancellation. We refund payments received, including the cost of the least expensive standard delivery option, within 14 days of being informed of the cancellation. We may withhold the refund until the goods are returned or evidence of return is provided. A deduction may be made for diminished value caused by handling beyond what is reasonably necessary to inspect the goods.

7. Voluntary 60-day money-back guarantee

In addition to statutory rights, SuperBonsai offers a voluntary 60-day money-back guarantee from delivery. Both unopened and opened or unsealed supplements may be claimed. The customer must contact info@superbonsai.eu within 60 days, provide the order number and briefly explain the request. We may require the product and packaging to be returned.

The customer pays return postage under this guarantee unless the item was incorrect, damaged or faulty. Once accepted, we refund the purchase price of the affected product. We may refuse claims involving abuse, excessive consumption, repeated claims from the same household or products not bought from SuperBonsai. Statutory rights are unaffected.

8. Faulty or misdescribed goods

Goods must be of satisfactory quality, fit for purpose where applicable and as described. Customers should contact info@superbonsai.eu if an item is faulty, damaged, incorrect or misdescribed. We will cover reasonable return costs and provide the remedy required by law.

9. Food supplements

Food supplements are not medicines and do not replace a varied diet or healthy lifestyle. Customers must follow the label, dosage and warnings. Medical advice should be obtained before use where the customer is pregnant, breastfeeding, taking medication, has a medical condition or allergy, or is otherwise unsure.

10. Promotions, bundles and free items

Promotional offers, free items and bundles are subject to the terms shown with the offer. Where a customer returns only part of a bundle, retained items may be repriced without the bundle discount only where this was clearly explained before purchase and is lawful.

11. Customer and order information

Customers must provide accurate and current information. SuperBonsai may refuse, limit or cancel orders where there is reasonable suspicion of fraud, commercial resale, promotional abuse or materially incorrect information.

12. Website use

The website must not be used for unlawful purposes, fraud, phishing, malware, misleading content, unauthorised scraping that disrupts the service, or conduct that interferes with security or operation. Access may be restricted in cases of misuse.

13. Intellectual property

SuperBonsai text, images, branding, logos and design are protected. Commercial copying, reproduction, distribution or use without prior written permission is prohibited except where permitted by law.

14. Reviews and user content

A customer submitting a review, image or video confirms that they have the right to share it and that it does not infringe third-party rights. SuperBonsai will use submitted content for publication or marketing only where there is a valid legal basis or consent.

15. Availability and corrections

We aim to keep the website secure and available but do not guarantee uninterrupted or error-free operation. We may correct obvious errors and update information. Statutory consumer rights remain unaffected.

16. Liability

Nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or liability that cannot lawfully be excluded. Subject to mandatory law, we are not responsible for loss caused by misuse, failure to follow warnings, or events outside our reasonable control.

17. Events outside our control

We may temporarily suspend obligations where performance is prevented by events outside our reasonable control, including transport disruption, natural events, war, epidemics, government action, strikes or failure of essential service providers. Statutory rights relating to serious delay remain available.

18. Complaints

Complaints may be sent to info@superbonsai.eu. We normally respond within 2 working days. Where further investigation is required, we will provide an expected response timeframe.

19. Privacy

Personal data is processed under the SuperBonsai privacy policy and applicable UK and European data protection rules.

20. Severability and changes

If a provision is invalid or unenforceable, the remaining provisions continue in effect. Changes apply to future contracts; an existing order remains governed by the version in force when the contract was made unless the law requires otherwise.

21. Governing law

These terms are governed by Dutch law, but a UK consumer retains the benefit of mandatory consumer protections applicable in their home jurisdiction. Courts with jurisdiction under applicable consumer law may hear disputes.
